New public call for the awarding of subsidies for the financing of Compliance programs

On September 18, 2023, was published in the Official Gazette of the Generalitat de Catalunya, the Resolution of September 14, 2023, under which the Catalan Competition Authority opens a public call for subsidies to finance Compliance programs aimed to prevent antitrust irregularities.

The subsidies contemplated in this call are governed by the Resolution of April 28, 2022, published in the Official Gazette of the Generalitat de Catalunya. The deadline for submission of applications began on September 19 and ends on October 18, 2023.

The following is a brief summary of the most relevant issues regarding this announcement:

  • The purpose of this subsidy is the adoption and implementation of Compliance programs or sub-programs on antitrust matters.
  • The possible subsidy can reach up to 70% of the budget for the adoption of such programs, with a limit of 10,000 €.
  • The Catalan Competition Authority has a budget of 200,000 € to grant these subsidies.
  • The distribution of these subsidies will be carried out through a competitive procedure, similar to a tender (in this sense, the proposal submitted to the Catalan Competition Authority will be crucial).

The Catalan Competition Authority celebrates the favourable reception of the first call for subsidies for Compliance programs related to competition, being this a pioneer at national level. These Compliance programs are considered instruments of great value that allow companies to prevent, detect and respond quickly to conduct prohibited by Law 15/2007, of July 3, 2007, on the Defense of Competition.

Finally, it should be noted that Molins Defensa Penal’s Compliance Department’s services include the designdevelopment and implementation of compliance systems in the area of antitrust law, whether these systems are independent or integrated into a broader regulatory compliance system.
